Given the common usage of the term, it seems perfectly reasonable to me that someone would consider the racially motivated killing of a person who was beset and outnumbered to be a lynching, even if does not meet the criteria of either Jeffrey Lord or USLegal.com.

There is no indication that Shirley Sherrod was intending to deceived anyone with her story.

It is one thing to disagree with her motivation, political views, understanding of race relations, or whatever. It is another just to try to find a reason to attack her personally.

I would think that a reasonable person (which evidently excludes Jeffrey Lord) would have a "know it when I see it" definition of lynching; a never-prosecuted extrajudicial death by bludgeoning of a black man by white men in the Jim Crow South pretty easily qualifies.
